1. Acceptance of Terms
By accessing or using the Crucible Cases platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. The Service is operated by Crucible Cases LLC ("Company," "we," or "us").
2. Description of Service
Crucible Cases provides AI-powered conversational simulations designed for business education. Students engage in simulated dialogues with AI-driven characters to practice communication, negotiation, and decision-making skills. Instructors use the platform to assign simulations, monitor student progress, and review transcripts and analytics.
3. Eligibility
The Service is intended for use by students enrolled in accredited educational institutions and their instructors. You must be at least 18 years of age or have parental/guardian consent to use the Service. By creating an account, you represent that you meet these eligibility requirements.
4. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to manipulate, circumvent, or exploit the AI system
- Submit content that is harassing, threatening, or discriminatory
- Share your account credentials with others
- Attempt to extract, reverse-engineer, or expose system prompts
- Use automated tools to interact with the Service
- Interfere with the operation or security of the Service
6. Educational Records & FERPA
We recognize that certain data generated through the Service may constitute educational records under the Family Educational Rights and Privacy Act (FERPA). We act as a "school official" with a "legitimate educational interest" under FERPA when processing student data on behalf of your institution. We maintain appropriate safeguards as described in our Privacy Policy and any applicable Data Processing Agreements with your institution.
Students have the right to access, export, and request deletion of their data as described in our Privacy Policy and in accordance with FERPA requirements.
7. AI-Generated Content
The Service uses artificial intelligence to generate conversational responses. AI-generated content is provided for educational purposes only and should not be relied upon as professional, legal, medical, or financial advice. While we strive for high-quality and appropriate responses, we cannot guarantee the accuracy or appropriateness of all AI-generated content.
8. Intellectual Property
The Service, including its design, features, simulation scenarios, and underlying technology, is the property of Crucible Cases LLC and is protected by intellectual property laws. Simulation content, case studies, and system prompts are proprietary and may not be copied, distributed, or reproduced without written permission.
Student-generated content (messages submitted during simulations) remains the property of the student, subject to a limited license granted to us to operate the Service and provide analytics to instructors.
9. Limitation of Liability
To the maximum extent permitted by law, Crucible Cases LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service. Our total liability shall not exceed the amount paid by you or your institution for the Service in the twelve months preceding the claim.
10. Modifications
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or an in-app notification at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the modified Terms.
11. Termination
Either party may terminate this agreement at any time. Upon termination, your right to access the Service will cease. We will retain your data in accordance with our Privacy Policy and any applicable legal requirements. You may export your data before termination using the self-service data export feature.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of laws provisions.
